Please read these Terms and Conditions carefully before using Provyuh. By creating an account or using the App, you agree to be bound by these Terms. If you do not agree, do not use the App.
1. Acceptance of Terms
By accessing or using Provyuh ("the App"), operated by vyuhworks LLC ("we", "us", or "our"), you agree to these Terms and Conditions and our Privacy Policy. These Terms apply to all users of the App, including users accessing Provyuh via the web (PWA), through the Apple App Store, and through the Google Play Store.
2. Eligibility & Account Registration
You must be at least 13 years of age to use Provyuh. By using the App, you represent and warrant that you are at least 13 years old. If you are between the ages of 13 and 18, you represent that your parent or legal guardian has reviewed and agreed to these Terms on your behalf.
We do not knowingly permit children under 13 to register or use the App. If we discover that a user is under 13, we will promptly delete their account and associated data.
You may register using Google Sign-In, Sign in with Apple, or email and password. You are responsible for maintaining the security of your account and all activity that occurs under it.
3. Platform-Specific Terms
3.1 Web / Progressive Web App (PWA)
Users accessing Provyuh via the web at provyuh.com are subject to these Terms in full. Subscriptions are processed through Stripe.
3.2 Apple App Store (iOS)
Users downloading Provyuh through the Apple App Store acknowledge the following:
- These Terms are an agreement between you and Vyuhworks LLC, not with Apple, Inc.
- Apple has no obligation to provide maintenance or support for the App.
- In the event of any failure of the App to conform to applicable warranties, you may notify Apple, and Apple will refund the purchase price (if any). To the maximum extent permitted by law, Apple has no other warranty obligation.
- Apple is not responsible for addressing any claims by you or any third party relating to the App.
- Apple is a third-party beneficiary of these Terms and may enforce them against you.
- Provyuh uses Apple's in-app purchase system for iOS subscriptions. See Section 4.2 for full subscription terms.
3.3 Google Play Store (Android)
Users downloading Provyuh through the Google Play Store acknowledge the following:
- These Terms are an agreement between you and Vyuhworks LLC, not with Google LLC.
- Google has no obligation to provide maintenance or support for the App beyond what is required under applicable law.
- Google is not responsible for addressing any claims by you or any third party relating to the App or your use of it.
- Provyuh uses Google Play Billing for Android subscriptions. See Section 4.3 for full subscription terms.
4. Subscription & Payments
Provyuh offers free and paid subscription tiers.
4.1 Web / PWA Subscriptions (Stripe)
Paid subscriptions for web users are processed securely through Stripe. By subscribing, you agree to:
- Pay the applicable subscription fee on a recurring basis as described at checkout.
- Stripe's Terms of Service and Privacy Policy for all payment processing.
- Our refund policy: subscriptions are non-refundable except where required by applicable law.
We reserve the right to change pricing with reasonable advance notice to existing subscribers.
4.2 Apple App Store Subscriptions (In-App Purchase)
Provyuh Premium is available as an in-app purchase through the Apple App Store. By subscribing via the iOS app, you agree to the following:
- Payment will be charged to your Apple ID account at confirmation of purchase.
- Your subscription automatically renews unless auto-renewal is turned off at least 24 hours before the end of the current billing period.
- Your account will be charged for renewal within 24 hours prior to the end of the current billing period.
- You may manage or cancel your subscription by going to iPhone Settings > [your name] > Subscriptions > Provyuh. Cancellation takes effect at the end of the current billing period — you retain Premium access until then.
- Subscription prices: $4.99/month or $49.99/year. Prices may vary by region and are subject to change with advance notice.
4.3 Google Play Subscriptions (In-App Purchase)
Provyuh Premium is available as an in-app purchase through Google Play. By subscribing via the Android app, you agree to the following:
- Payment will be charged to your Google Account at confirmation of purchase.
- Your subscription automatically renews unless cancelled before the end of the current billing period.
- You may manage or cancel your subscription through the Google Play app (tap your profile icon > Subscriptions > Provyuh). Cancellation takes effect at the end of the current billing period — you retain Premium access until then.
- Subscription prices: $4.99/month or $49.99/year. Prices may vary by region and are subject to change with advance notice.
4.4 Free Trial & Promotional Offers
Provyuh offers a free tier with premium features. A free trial of Premium is available for all new users — no payment required upfront. Your trial will automatically end at the conclusion of the trial period and your account will revert to the free plan unless you actively choose to subscribe.
Provyuh may also offer promotional discount codes from time to time. By applying a promotional code, you acknowledge that:
- Promotional pricing applies only for the duration specified at the time the code is redeemed.
- At the end of the promotional period, your subscription will automatically renew at the then-current standard rate unless you cancel before the promotional period ends.
- Promotional codes are non-transferable, may not be combined with other offers, and are subject to expiration dates and eligibility requirements.
We reserve the right to modify or discontinue promotional offers at any time. Cancellation instructions are available within the App and at provyuh.com.
5. Recipe Imports & Third-Party Content
5.1 Importing from External Sources
Provyuh allows you to import recipe content from websites, YouTube, Instagram, TikTok, and other platforms. By using this feature, you acknowledge that:
- You are importing content for your own personal, non-commercial use only.
- Provyuh does not host, claim ownership of, or take responsibility for third-party content imported by users.
- Imported recipes are stored in your personal account and are intended solely for your private use.
- We do not guarantee the accuracy, completeness, or availability of content imported from third-party sources.
- You are responsible for ensuring your use of imported content complies with the intellectual property rights of the original creators.
5.2 View Source
The "View Source" feature links back to the original source URL of a recipe. Provyuh does not reproduce or republish third-party content — it facilitates access to the original URL for your reference.
6. Restrictions on Sharing & Distribution
You may not share, export, publish, or distribute recipes saved in your Provyuh account to external platforms or third parties. This includes:
- Posting saved recipes to social media platforms.
- Distributing recipe content via email or messaging applications outside the App.
- Republishing imported content on websites or blogs.
- Using any automated means to extract or export your recipe library.
This restriction is in place to respect the intellectual property rights of original recipe creators and content owners.
7. AI-Powered Features
Provyuh uses AI features powered by third-party providers to generate personalized meal plans, extract recipes, suggest nutrition targets, and provide dietary recommendations. By using AI features, you acknowledge that:
- AI-generated content is for informational purposes only and may not always be accurate or complete.
- Your inputs (dietary preferences, health goals, food photos, recipe requests) may be processed by third-party AI services per their privacy policies.
- You should not rely solely on AI-generated nutritional information for medical, clinical, or dietary treatment decisions. Consult a qualified healthcare professional before making significant changes to your diet.
- We do not use your personal recipes, meal plans, or health data to train AI models.
8. Health & Nutrition Data
Provyuh may ask you to provide health-related information such as calorie targets and dietary restrictions to personalize your experience. By providing this information, you acknowledge that:
- This data is used solely to generate personalized meal recommendations within the App.
- Provyuh is not a medical service and does not provide medical advice or clinical dietary guidance.
- You may choose not to provide health data, though some personalization features may be limited as a result.
- You can request deletion of your health data at any time by contacting support@provyuh.com.
9. User Content
You retain ownership of any recipes, meal plans, or content you create directly within the App. By using the App, you grant Vyuhworks LLC a limited, non-exclusive license to store and display your content solely for the purpose of providing the service to you. We do not use your personal recipes or meal plans to train AI models.
10. Intellectual Property
The Provyuh name, logo, design, and original features are the intellectual property of Vyuhworks LLC. You may not copy, reproduce, or create derivative works from any part of the App without our prior written consent.
11. Prohibited Conduct
You agree not to:
- Use the App for any unlawful purpose.
- Attempt to gain unauthorized access to any part of the App or its infrastructure.
- Use automated tools to scrape, extract, or mass-download content.
- Impersonate another person or entity.
- Upload or transmit harmful, offensive, or malicious content.
- Use the App to provide false health or dietary information that could harm others.
12. Termination
Either party may terminate these Terms at any time. You may cancel your subscription and delete your account through the App or by contacting support@provyuh.com. We may suspend or terminate your access if you violate these Terms. Upon termination, your right to access the App ceases. Provisions that by their nature should survive termination (including intellectual property, disclaimers, and limitation of liability) will remain in effect.
13. Disclaimer of Warranties
The App is provided "as is" and "as available" without warranty of any kind. We do not warrant that the App will be uninterrupted, error-free, or free of harmful components. Nutritional information provided is estimated and not a substitute for professional medical or dietary advice.
14. Limitation of Liability
To the maximum extent permitted by law, Vyuhworks LLC shall not be liable for any indirect, incidental, special, or consequential damages arising out of your use of or inability to use the App, even if we have been advised of the possibility of such damages.
15. Governing Law
These Terms shall be governed by the laws of the State of California. Any disputes shall be resolved in the courts located in Sacramento County, California.
16. Changes to These Terms
We reserve the right to update these Terms at any time. We will notify you of significant changes via email or in-app notification at least 14 days before changes take effect. Continued use of the App after changes are posted constitutes your acceptance of the revised Terms.
